Question
My child was born and only lived 40 minutes. Can this child be my qualifying child for the earned income credit and the child tax credit?
Answer
Yes, if you meet the requirements, you may claim:

1. The Earned Income Credit

Generally, a child must live with you in the United States for more than half of the tax year to be a qualifying child. You may treat a child who was born alive or died in 2021 as having lived with you..."

"When is the latest date a child can be born in the tax year to qualify as your dependent for tax purposes? You might be surprised by the answer: December 31. It's possible to claim your newborn as a dependent as long as it's documented as a live birth and they were born at any time during the tax year, even if it's 11:59 p.m. on the last day of the year."

The U.S. gov -

"If you’re pregnant or planning to get pregnant
If you don’t have health coverage
Health coverage makes it easier to get the medical check-ups and screening tests to help keep both you and your baby healthy during pregnancy."

@ZeroSum00 A person is someone that is legally recognised. It does not deny that unborn babies are alive. There is laws punishment for unlawful deaths of unborn babies if you kill the murder.
