Congress has created offices and agencies within the legislative branch, right? The Library of Congress, Congressional Research Service, the erstwhile Office of Technology Assessment, etc.

If the Supreme Court overturns Humphrey's Executor, could independent agencies migrate to the legislative branch?

@interfluidity

Independent agencies will always be unconstitutional and incompatible with a representative government. And independent power will always eventually be abused.
So hopefully, they will all just disappear. The need for them is imaginary. they only serve to give congress cover for ineptitude and corruption.

The legislative branch cannot acquire executive power for itself anyway.

@Phil democracy in our constitution is invested in Congress. the President is not elected by the public, and the notion of one man representing the fractious public is absurd. “independence” is conferred by Congress against the influence of that one man, democratically and often appropriately. that this Supreme Court might strip that basic institutional and democratic prerogative from our system is on them. no agency is ever independent of Congress, the heart of our democracy.

@interfluidity
As they now stand, independent agencies are vested with exective power. The constitution vests ALL executive power in the president of the us. The Electoral college is elected by the people, it then elects the president. The president is still representative of the will of the people. The entire foundation of the constitution is split, limited power, with sovereignty belonging to the people. Anybody with an ounce of sense can see that indpendent agencies are repugnant to that.

@Phil are independent courts repugnant to democracy? can the people never choose a decision-making procedures other than the whim of the people as expressed through the whim a quasi elected quasi king?

under our constitution btw the electoral college is not elected. its weird quasi electedness is an ad hoc ex post state level innovation.

under our constitution democratically elected Congress is supreme. and it is, even with respect to independent agencies.

@interfluidity

Intependent courts are constitutional and there is a mechanism for control. Independent agencies are not and in practice have never answered to congress.
NO SANE person with any understanding of history would want to subject himself to an to an agency not subject to any vote. the idea is incombatable with a free society.

Originally the Electors for the electoral college were chosen by the state legislators who were representatives of the people and answered to them.

@interfluidity
There are two kinds of people that this appeals to.

1. Control freaks that want to run everybody else's life.
2. Losers who fret that they can't run their own.

@Phil independent agencies are entirely answerable to Congress. the one democratic branch of government.

@interfluidity
Not in practice.
Name one instance, in the last 30 years where there was actually effective congressional oversight?

All the stuff that DOGE is uncovering proves conclusively that those agencies are just places to hide corruption and incompetence and until now, nobody had any real say in what they did or who populated them.

You have to be absolutely nuts, or a beneficiary of the corruption to think this has been a good system.

@Phil DOGE is incompetence and corruption incarnate.

@Phil I agree Congress has been dysfunctional the last few decades. But empowering a tyrant is no solution to that. Our system requires an assertive, functional Congress. Electoral reform and institutional changes can deliver that.

The Felon Pope :popephil:

@interfluidity
We haven't empowered a tyrant. He is exercising executive power that is vested in him by the constitution. Finally.

And dismantling the corrupt agencies is an unmitigated good. Stoping wasted spending is an unmitigated good.

So far nothing but good has come out of this administration. A beautiful contrast to the nothing but disaster that came out of the last one.

And Doge is the BEST thing I've seen in govt in my life time.

@Phil He is sending people into life imprisonment who have done nothing at all to merit that, with no meaningful process. he is a tyrant. his rank evil is leavened only by his idiocy, buffoonery, narcissism. Perhaps he’s incapable of understanding the horrors for which he is responsible. His supporters, however, have no such excuse.

@Phil you live in a bubble of your own construction, and from that vantage instruct us all on the proper application of executive authority, in a democracy no less. but the people you support are actively dismantling democracy, incarcerating innocents and throwing away the key, hinting very strongly that any of us (“homegrowns”) could be next. this is tyranny that has even shed its fig leaves, but you sing songs to yourself and look away. newsweek.com/merwil-gutierrez-

Newsweek · ICE Agents Realize They Arrested Wrong Teen, Say 'Take Him Anyway'By Billal Rahman

@interfluidity
Nothing but heresay, which you automatically believe because it matches your feels. Extroidinary claims require extroidinary evidence. For this there is NO evidence, just a liberal spouting off and they are known to stage stuff and spread lies. So this is meaningless.

@interfluidity
And this attachment, if true, is unfortunate. However, he was here illegally. Entering a country in violation of it's laws is a risky business. I hope this one is sorted out eventually and he is returned to his home country.

However, ICE hasn't commented and we can't be certain that this is completely true. And based on my years long analysis of press stories, along with a large group of people, there is about a 10% chance that it is.

@interfluidity
You start with fretting/fears, based on an ideology being in power that you don't support, than draw imaginary conclusuions, applying twisted logic to your feels.This is why you have a huge double standard. Libs are the ones that lord it over Americans and try to run our lives. They do this under the guise that it's for our own good. They have such hubris that they believe they know what is for our good better than we do. DJT is obviously returning power to the people.

@interfluidity
Oh please, if Trump were a tyrant, he would be rounding you and your liberty destroying ilk up. For what its worth, I would object to that. But he isn't imprisioning anybody, he is returning prisoners that were released into the US by foreign countries, thanks to typical liberal stupidity, to prison where they belong.
They are all illegal invaders, not much different than a foreign army and as such are not entitled to the same due process that you would be.
