Wednesday’s ruling marks the first time an appeals court has materially weighed in on #Trump’s #BirthrightCitizenship order, which has come under 10 lawsuits across the country. Though the case will continue before the #9thCircuit, the #DOJ could now seek emergency relief from #SCOTUS.

The 3-judge appeals panel wrote in its ruling that the admin had “not made a ‘strong showing that [they are] likely to succeed on the merits’ of this appeal.”

#Trump’s order would restrict #BirthrightCitizenship from being extended to children born on US soil to parents without permanent legal status…. Multiple judges have found the order is inconsistent w/ #SCOTUS’ longstanding interpretation of the #14thAmendment.

The pushback comes as #Trump tries to dismantle govt agencies & eliminate large swaths of the federal workforce are being held up by the courts. Judges have also blocked Trump… from moving forward w/mass federal #buyouts, from placing thousands of #USAID workers on leave & from implementing an #ExecutiveOrder that seeks to end #BirthrightCitizenship for anyone born in the #US.

I cannot tell you the worst thing #Trump did in his first hours—“the worst” is a subjective assessment….There is, however, one #ExecutiveOrder that attempts to nullify an entire constitutional amendment by fiat….
“Protecting the Meaning & Value of American Citizenship”—better known as the #BirthrightCitizenship executive order—attempts to cancel the #14thAmendment to the #US #Constitution. Getting rid of constitutional amendments via executive order is new, &, for me at least, “the worst.”

Trump signed an #ExecutiveOrder that will attempt to amend the #14thAmendment to revoke #BirthrightCitizenship. The president cannot change the #Constitution on his own, so it’s not yet clear how Trump plans to withhold the benefits of #citizenship to a group of people born in the #UnitedStates. The move is all but certain to be challenged in court.
